12:00-1:45pm.  The US Department of Justice, Securities and Exchange Commission, and other US regulators, including Treasury and Commerce, continue to aggressively investigate and enforce against corporates, private equity houses and financial institutions, particularly those with operations in China, Indonesia, and across Asia.
The US authorities are also increasing their cooperation with their counterparts across borders, including according to press reports their counterparts in China. This likely means continued or more multi-jurisdictional investigations of conduct in Asia. But how the US investigates and settles alleged violations may be changing. From the Yates Memo, the FCPA pilot program and the hiring of a compliance counsel, Hui Chen, the DOJ in particular may be altering its enforcement objectives and approach. It has been nearly a year since some of these changes were announced – are we seeing a new approach, should companies particularly in Asia be altering their strategies to conduct internal investigations and interface with regulators to best navigate US enforcement risk?
To provide some insight into the potential changing landscape of US enforcement, Andy Meehan, of Morgan Stanley, will moderate a discussion with two former Assistant US Attorneys who now specialize in defending companies that are subject to US enforcement.
Adam Siegel of Freshfields Bruckhaus Deringer in New York is a former Assistant US Attorney and expert practitioner with nearly two decades of experience both as a prosecutor and defense attorney investigating potential violations of the FCPA and other alleged criminal conduct. Adam will be joined by Dan Braun, who recently joined Freshfields Bruckhaus Deringer in Washington DC, after spending 16 years working for the US Department of Justice and most recently serving as the Deputy Chief for Litigation in the Fraud Section of the Criminal Division, where he managed some of DOJ’s most significant cases.
