Dear Committee Members,
This meeting of the Law Committee is part of our monthly brainstorming sessions during which the Committee members, under the direction of an expert in the field, share their views, concerns and best practices with respect to tricky Asia-wide issues. These are questions for which the laws are unsettled and lack uniformity across the region, and where cultural differences raise specific challenges on the ground.
On March 14, we will be discussing How to Design a Sensible Gift and Entertainment Policy across Asia. In recent years, businesses have become increasingly aware of the existence of the FCPA and the UK Anti-Bribery Act, as well as local laws around the region targeting corruption both of public officials and in the private sector. However the implementation of those laws consistently across jurisdictions, and in ways that do not put businesses at a disadvantage continues to raise numerous challenges.
  The issuance in November 2012 of guidelines by the US Justice Department and the Securities and Exchange Commission regarding the FCPA do not seem to have answered all questions.
How to evaluate the extent of your client's or your organisation's exposure and how to design a workable response? Is there a one-size-fits-all solution? How to keep in tune with developments?
