Dear Committee Members,
This meeting of the Law Committee is part of the recently-launched series of brainstorming sessions during which Law Committee members – in-house and private practitioners – share their views, concerns and best practices with respect to tricky Asia-wide issues. These are questions for which no answer is straightforward, because the laws are unsettled and lack uniformity across the region, and also because cultural differences raise specific challenges on the ground.
On February 1, we will be discussing How to collect and make the best use of Competitive Intelligence in light of the proliferation of Competition Laws across Asia. Western Multinationals face fierce competition from a growing number of Asia-based champions. As in any new business environment, they need guidance, benchmarking and a better understanding of their competitive environment. Intelligence, at the core, is a key decision driver.
Data collection in emerging markets is a difficult exercise and is now further complicated by the regulatory challenge imposed by new competition laws developing around the region.
We will be discussing how to identify the relevant data, collect it, analyse it, transfer it across jurisdictions and disseminate it within your organisation. We will also address the increasingly complex regulatory environment and ways to maximise your client's or your organisation's ability to comply with all applicable laws.
I will be happy to moderate the discussion, using my hat as Head of Baker & McKenzie's Greater China Antitrust Practice. At the end of the session, we will also discuss planning for the Law Committee's activities for the first semester of 2013.
