Enforcement of China's Antimonopoly Law (AML) surged in the last two years, with unprecedented penalties against foreign and domestic companies for price-fixing, resale price maintenance, and abuse of intellectual property rights.  Antitrust scrutiny of international mergers has also intensified, with many transactions stalled and some thwarted in China.   Chinese antitrust enforcement has converged with prevailing international practices in many areas while deviating markedly in others.  This antitrust enforcement agenda reflects complex policy goals and the political incentives for regulators in Xi Jinping's China.
This session will assess the antitrust challenges facing multinational companies operating in China.
This session will cover:
Trends in investigations of anticompetitive conduct by the National Development and Reform Commission (NDRC)  and State Administration of Industry & Commerce (SAIC) Trends in merger review by the Ministry of Commerce (MOFCOM) Role of the Chinese courts in Chinese antitrust enforcement Implications for standard-essential patents and global intellectual property strategies Impacts on China's bilateral and multilateral trade and investment relationships
